Please ensure you read carefully and understand all rights and restrictions described in this PESARO SYSTEM End User License Agreement. You will be asked to review and accept the terms and conditions of this Agreement.
This Agreement is between you (an individual or a legal entity) and PESARO SYSTEM for the enclosed PESARO SYSTEM software product, which includes computer software for Desktop, Mobile, and Web and may include associated media, printed materials, and "online" or electronic documentation (SOFTWARE). By installing and/or using the SOFTWARE, you agree to be bound by the terms of this Agreement. Whether in Desktop, Mobile, or Web version.
If you do not accept the terms and conditions of this Agreement, then you must not install, use, nor purchase the SOFTWARE license.
- having read this Agreement.
- affixing your signature, thus accepting the terms and conditions of the Agreement.
- having tested the product in the FREEWARE version before purchasing a license.
- being aware that the FREEWARE version has exactly the same functionalities as the paid
version.
- being aware of all product functionalities, and thus excluding PESARO SYSTEM from any liability
regarding missing functionalities.
- being aware that PESARO SYSTEM holds user data exclusively for the proper functioning of the
software, and that sensitive data is encrypted, and that not even PESARO SYSTEM is able to read
it.
- being aware that the software might not work in case of computer suspension, lack of internet
connection, screenshot activation, presence of malware on the computer, presence of viruses on the
computer, intervention of some antivirus or firewall that might prevent proper software functioning,
lack of free memory available on the computer, and excluding PESARO SYSTEM from any
liability.
- being aware that PESARO SYSTEM is not required to maintain previous and/or dated versions of the
software and it is therefore the user's task to save the installation file in a safe and retrievable
place
in case of reinstallation.
- being aware that PESARO SYSTEM has the right to decide the prices of its products and to handle
changes at any time. The user will always be informed in advance at least 30 days before any
rate change.
- assuming all responsibility, and thus excluding PESARO SYSTEM, for any damages that may derive
from the use of the software.
- excluding PESARO SYSTEM from any legal proceeding in case of program malfunction.
 
The SOFTWARE PRODUCT is protected by international copyright laws and treaties, as well as other intellectual property laws and treaties. The SOFTWARE PRODUCT is licensed, not sold. NOTE: The terms of any printed copy of the Agreement enclosed with the SOFTWARE PRODUCT will prevail over the terms of any online Agreement found within the SOFTWARE PRODUCT.
PESARO SYSTEM grants you, as an individual, a personal license valid for one company, to run and use copies of the SOFTWARE PRODUCT to operate with compatible operating systems. If you need to use the product on multiple companies, then you will have to purchase a license for each company.
You may install copies of the SOFTWARE PRODUCT on an unlimited number of Desktop and Mobile computers, provided they belong to the same company.

PESARO SYSTEM will periodically publish software updates that the user can download and install via the website or official channels.
PESARO SYSTEM provides a freeware version of the software so that the customer can test all product functionalities before purchasing a license. The freeware version has the same functionalities as the licensed version; it is indeed the same executable, the same program, the same App. The freeware version is not limited in any functionality and does not prevent full product testing. The freeware version has a time limitation after which the user can decide whether to purchase the license or not, with no obligation.
Title and intellectual property rights in and to the SOFTWARE PRODUCT (including but not limited to any images, photographs, animations, video, audio, music, text, and "applets" incorporated into the SOFTWARE PRODUCT), the accompanying printed materials, and any copies of the SOFTWARE PRODUCT are owned by PESARO SYSTEM or its suppliers. Title and intellectual property rights in and to content accessed through the SOFTWARE PRODUCT is the property of the respective content owner and may be protected by copyright or other intellectual property laws and treaties. This Agreement grants you no rights to use such content. PESARO SYSTEM reserves all rights not expressly granted under this Agreement.
PESARO SYSTEM reserves the right to change license prices at any time. The user will always be informed in advance at least 30 days before any rate change.
User personal data is processed in accordance with current legislation on personal data protection and in particular with European legislation on personal data protection (GDPR).
PESARO SYSTEM will hold user data entered during software use exclusively for the proper functioning of the software, and sensitive data will be encrypted. Not even PESARO SYSTEM will be able to read such data.
PESARO SYSTEM undertakes not to use user personal data for purposes other than managing the user and their account.
Data will be saved on PESARO SYSTEM servers and the user will be able to access it during use of the software in FREEWARE version and subsequently with a license. Once the license expires, the user will no longer be able to access it and data will be removed one year after the license expiration date. If the user purchases a new license, data will be accessible again provided that one year has not passed since the expiration of the previous license.
Pursuant to art. 52 et seq. of the Consumer Code (Legislative Decree 206/2005), the Consumer generally has the right to withdraw from the contract within 14 days of purchase. However, the following specific provisions apply due to the nature of the Software and the trial period offered:
For any dispute arising from or deriving from the application of this contract, the parties conventionally derogate jurisdiction in favor of the court of Pesaro (Italy).
